Not a Brokerage. OpenLy is a showing-assistance service and is not a real estate brokerage, regulatory agency, trade association, or settlement service provider. OpenLy does not create an agency relationship with the requesting agent’s client. The requesting agent and their brokerage remain responsible for representation of the client and the underlying real estate transaction.
State Law & Brokerage Responsibility. Requesting agents and brokers are responsible for confirming that their use of OpenLy and any showing-assistance arrangement complies with applicable Nevada law, Nevada Real Estate Division requirements, brokerage policies, MLS rules, commission rules, written buyer-agreement requirements, and any other applicable regulations.
Service Provided As-Is. OpenLy services are provided on an “as-is” and “as-available” basis, subject to showing-agent availability, property access, listing-agent approval, scheduling restrictions, and circumstances outside OpenLy’s control. To the extent permitted by law, OpenLy makes no guarantee that a requested showing time or service will be available or successfully completed.
No Opinions, Advice or Representation. The OpenLy showing agent is present solely to provide showing assistance and does not represent the buyer. The showing agent will not provide opinions or advice regarding property value, price, condition, neighborhood, location, market conditions, negotiations, offers, contracts, or other substantive real estate matters. Those questions should be directed to the client’s representing agent.
Client Relationship. OpenLy does not solicit the requesting agent’s client or attempt to interfere with the existing agent-client relationship. Your clients remain your clients.
